Terms of service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Mystor platform (“Mystor”, “we”, “us”, “our”).

By accessing or using Mystor, you agree to these Terms.

If you do not agree, you may not use the platform.

2. Platform Role

Mystor is a digital marketplace platform that enables independent creators (“Creators”) to publish and sell educational guides to users (“Learners”).

  • Creators are independent sellers
  • Mystor acts as an intermediary, hosting provider, and payment facilitator
  • Mystor does not create, own, or endorse user-generated content

A purchase on Mystor is a transaction between Learner and Creator, facilitated by Mystor.

3. Eligibility and Accounts

Mystor is a digital marketplace platform that enables independent creators (“Creators”) to publish and sell educational guides to users (“Learners”).

  • You must be at least 18 years old
  • You must create an account to purchase or access content
  • You must provide accurate and complete information

You are responsible for:

  • maintaining account security
  • all activity under your account

4. Nature of Purchase (License, Not Ownership)

When you purchase a guide:

  • You receive a limited, personal, non-transferable license
  • You do not acquire ownership of the content or intellectual property

You may not:

  • redistribute
  • resell
  • share access
  • reproduce content outside the platform

5. Payments and Fees

Payments are processed by third-party providers, including Stripe.

  • Mystor does not store card or banking details
  • Taxes may be calculated and collected automatically

Mystor charges a platform fee on transactions.

Mystor reserves the right to:

  • change fees in the future
  • apply updated fees to future transactions

Fee changes will not apply retroactively.

6. Creator Earnings, Withholding, and Offsets

Creators earn revenue from sales, subject to platform fees and applicable deductions.

Mystor may:

  • withhold payouts
  • delay payouts
  • offset amounts
  • recover funds from creator balances or future earnings

including but not limited to:

  • refunds
  • chargebacks/disputes
  • payment processor fees
  • fraud or abuse
  • intellectual property violations
  • violation of these Terms

Creators are responsible for losses caused by their content or conduct.

7. Refund Policy

Refunds are governed by Mystor's Refund Policy.

For digital content, refunds are not guaranteed.

A refund may be considered only if ALL conditions are met:

  • request is made within 72 hours of purchase
  • video playback has not been initiated
  • no downloadable content has been accessed

For clarity:

  • video is considered accessed once playback begins
  • downloadable content is considered accessed once a secure access or download link is generated or provided

Mystor reserves full discretion in evaluating refund requests.

8. Chargebacks and Payment Disputes

If a user initiates a chargeback or payment dispute:

  • Mystor may investigate and take appropriate action
  • associated losses, fees, and penalties may be recovered from the Creator
  • Mystor may suspend payouts or accounts during investigation

9. Content Ownership and Creator Responsibilities

Creators represent and warrant that:

  • they own or have rights to all content
  • content does not infringe third-party rights
  • content complies with applicable laws

Creators are solely responsible for:

  • accuracy of content
  • safety of instructions
  • compliance with laws and regulations

10. Safety and Educational Use

All content on Mystor is provided for educational purposes only.

  • Mystor does not verify safety or suitability
  • Users act at their own risk

Creators must include safety notes for their guides.

Mystor is not responsible for:

  • injuries
  • damages
  • losses arising from use of any guide

11. Prohibited Conduct

You agree not to:

  • violate laws
  • infringe intellectual property
  • upload content you do not own
  • impersonate another person
  • provide false information
  • circumvent platform protections
  • interfere with platform systems

12. Content Moderation and Removal

Mystor may:

  • remove content
  • restrict visibility
  • suspend accounts

This may occur:

  • without notice in serious cases
  • to comply with law or policy

13. Account Suspension and Termination

Mystor may suspend or terminate accounts for violations.

If a Creator is suspended:

  • unpaid earnings may be withheld
  • access to content may be restricted
  • Mystor may recover applicable losses

Users may stop using the platform at any time.

14. Access After Creator Removal

Where technically and legally possible:

  • Learners may retain access to previously purchased content

However, access may be revoked if required due to:

  • legal obligations
  • safety concerns
  • intellectual property violations

15. Intellectual Property and Anti-Piracy

All platform content is protected.

You may not:

  • copy or redistribute content
  • record or reproduce guides for distribution
  • share account access

Mystor may revoke access for violations.

16. Limitation of Liability

To the maximum extent permitted by law:

Mystor is not liable for:

  • indirect or consequential damages
  • loss of income or opportunity
  • outcomes resulting from use of content

Mystor's total liability is limited to:

  • the amount paid by the user in the previous 12 months, or
  • €100, whichever is greater

17. Indemnification

You agree to indemnify and hold Mystor harmless from claims arising from:

  • your use of the platform
  • your content
  • your violation of these Terms

18. Changes to Terms

Mystor may update these Terms. Continued use of the platform constitutes acceptance of changes.

19. Governing Law and Disputes

These Terms are governed by the laws of Estonia. Disputes are subject to Estonian courts. Nothing in these Terms limits mandatory consumer rights under applicable law.
